• Location-based attendance verification
• Leave management
• Employee tracking for field workers

• HR management features

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account or have one created by your organization's administrator. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibilities

You agree to:

• Provide accurate and complete information
• Maintain the security of your password
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to manipulate or falsify attendance records
• Use location spoofing or other means to circumvent geofencing
• Share your account credentials with others
• Attempt to access accounts or data belonging to other users
• Interfere with or disrupt the Service
• Upload malicious code or content
• Reverse engineer or attempt to extract source code

5. Location Services

The Service uses location data for attendance verification and employee tracking. By using location-based features, you acknowledge that:

• Your location may be recorded when you punch in/out
• Background location tracking (if enabled) will share your location with your organization
• Location accuracy depends on your device and environment
• You can disable location services in your device settings at any time

6. Intellectual Property

The Service and its original content, features, and functionality are owned by AttendancePayand are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

8. Service Availability

We strive to provide reliable service but do not guarantee that the Service will be available at all times. We may perform maintenance, updates, or experience technical issues that temporarily affect availability.

9. Termination

Your access to the Service may be terminated:

• By your organization's administrator at any time
• By us for violation of these terms
• Upon termination of your employment with your organization

Upon termination, your right to use the Service will immediately cease.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATTENDANCEPAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

You agree to indemnify and hold harmless AttendancePay, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these terms.
